The service
The final terms should define Fit Flex Club's online fitness, nutrition and lifestyle coaching service and clearly state that it is not medical diagnosis, treatment, physiotherapy, emergency care or a substitute for qualified healthcare advice.
Client responsibilities
The final terms should require accurate health disclosure, following appropriate medical advice, obtaining clearance where requested, and telling Fit Flex Club when health or circumstances affecting the plan change.
Payment and refunds
The final terms should state the program fee, when payment is due and the confirmed non-refundable clause. Any payment processor-specific terms should also be reviewed.
Holds and switches
This section should incorporate the final hold and switch rules once maximum hold length, permitted frequency, notice periods, transfers, goal changes, emergency exceptions and expiry of unused days are defined.
Intellectual property
The final terms should explain that personalised diet plans, exercise materials and the exercise e-book are provided for the individual client's personal use and are not licensed for redistribution, resale or public sharing.
Limitation of liability
A qualified lawyer should draft the final limitation-of-liability language, including any exclusions that are not permitted under applicable law.
Ending the program
The final terms should define circumstances in which either the client or Fit Flex Club may end the coaching relationship, including safety concerns, non-payment or situations where coaching is no longer appropriate.
Governing law and jurisdiction
The applicable governing law, courts or dispute-resolution process should be confirmed by legal counsel before this clause is published.
